Commentary about this from a process server: I am not an attorney, but understand concepts required to successful serve process. However, once concept I could never agree with is a claim of invalid service when respondent appears in court. If service was unsuccessful by the letter of law, isn’t the spirit of the law to notify respondent of pending action? If they were notified, and appeared in court, wouldn’t the spirit of the law have been complied with?
