I know you didn’t find the defendant, but can you just give me Process Server Affidavit showing it’s served?

We get requests all the time from unscrupulous individuals looking to skate legal process service requirements.  Many come from unsuspecting sources, sometimes even surprising us… it’s not uncommon for us to get these requests from attorneys or even government officials!

Process Servers act as impartial representatives of the originating court or jurisdiction process service notice.  What we do effects the entirety of all proceedings after service has been completed.  We can be held liable, both civil and criminal, for fraudulent affidavits.  Most affidavits must be notarized.

  • “Can you just post the summons on the front door, and give me an affidavit indicating personal process service was completed?”
  • “I don’t care who is there, give the summons and complaint to anyone who is there. But I need an affidavit showing you personally served the defendant.”
  • “Just drop the legal papers anywhere in the vicinity and send us over an affidavit right away showing you served them.”

The answer is no. No.  And, No.

We can do your Service of Process however you want us to, but you are responsible for complying for any applicable laws or regulations. Although you are paying, the originating Court is who our primary responsibility is affixed.  We will follow your written instructions, but our affidavit will also reflect what we actually did. If our actions were outside normal operating standards, clients request will also be noted in affidavit.
